1. Acceptance of Terms

Welcome to 2nd Line+! These comprehensive Terms of Use (“Terms”) meticulously outline the terms and conditions governing your utilization of the 2nd Line+ app provided by MobileOcean. By accessing, using, or downloading the 2nd Line+ app, you unequivocally agree to comply with and be bound by these detailed Terms. If you do not agree with any part of these Terms, we encourage you to refrain from using the app.

2. Use of the 2nd Line+ App

2.1 Eligibility: To use the 2nd Line+ app, you must be at least 16 years old. By using the app, you affirm that you meet this age requirement.

2.2 User Account: In order to access certain features, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account information and agree to accept responsibility for all activities that occur under your account.

2.3 Prohibited Activities: Users are expressly forbidden from engaging in any activity that is illegal, harmful, deceptive, or violates the rights of others. Prohibited activities include, but are not limited to, spamming, hacking, or engaging in any form of harassment.

2.3.1 Misuse of Services:

You agree not to misuse the Services provided by 2nd Line+. This includes but is not limited to:

(a) Copying, reverse engineering, disassembling, attempting to derive the source code of, modifying, or creating derivative works of the Licensed Application, Website, or Services, or any part thereof.

(b) Interfering with or disrupting any user, host, or network forming any part of the Services.

(c) Accessing or searching the Services by any means other than the supported interfaces made available to you.

(d) Exploiting the Services in any unauthorized way, such as trespassing or burdening network capacity.

(e) Engaging in unusually high usage of the Services from individual accounts or employing any automated programs such as bots or clones (non person-to-person communications) that may impair our ability to provide the Services.

(f) Performing unusual calling patterns inconsistent with normal, individual use, including regular calls of short duration or calls to multiple numbers in a short period of time.

(g) Using the Services for call-in lines, call centers, conference calling, trunking (to a PBX or otherwise), “spamming”, sending junk or bulk messages, or any other high volume multi-person calling or messaging purposes on Unlimited Subscription plans.

2.3.2 Prohibited Activities:

You shall not engage in any activities that are prohibited by law or that violate the rights of others. This includes but is not limited to:

(a) Using the Services for pornographic, indecent, obscene, defamatory, or other unlawful purposes.

(b) Engaging in Internet activities that would violate the privacy rights of others, including copying, storing, accessing, or using personally identifiable information about another registered user in a way that is inconsistent with our Privacy Policy or these Terms.

(c) Engaging in conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which may harm the Company or users of the Services.

(d) Sending harassing and/or threatening messages to others or engaging in abusive or disruptive behavior.

(e) Discriminating against or harassing anyone on the basis of race, national origin, religion, gender, sexual orientation, disability, medical condition, marital status, age, or gender identity.

2.3.3 Monitoring and Enforcement:

The Company reserves the right to monitor access to and use of the Services for purposes such as securing and improving the Services, fraud prevention, risk assessment, investigation, customer support, and ensuring compliance with these Terms. We may refuse service, terminate accounts, remove or edit content, and revoke your license if you fail to comply with these Terms or engage in illegal or criminal behavior.

2.3.4 Emergency Calling:

Please note that the Services provided by 2nd Line+ are not intended for emergency calling, including 911 or other emergency numbers. You must use your primary number or cell phone for emergency calls. By using the Services, you acknowledge and agree that the Company is not liable for any claims, damages, or losses arising from attempts to dial 911 or make emergency calls using the Services.

2.3.5 TEXTING SERVICE – TEXT-TO-911 LIMITATIONS

Note that most consumers in the U.S. CANNOT access emergency 911 services by sending a text message from a phone. Even where it is possible to send a text message to emergency 911 services, it is preferable to place a call to emergency 911. Even if sending a text message to emergency 911 services is possible, the emergency call taker will not receive your location information automatically; instead, you will have to supply such information. If you attempt to send a text message to 911 and it cannot be processed, you will receive a “bounce back” message that the text message was not delivered.
PLEASE ALSO NOTE THAT THE OUTBOUND SERVICE SHOULD NOT BE USED TO PLACE EMERGENCY 911 CALLS AND IT IS A VIOLATION OF THESE T&Cs TO RELY ON THE OUTBOUND SERVICE FOR PLACING 911 CALLS. SEE OUTBOUND SERVICE (UNITED STATES) – NO 911 CALLING FUNCTIONALITY FOR MORE INFORMATION

OUTBOUND SERVICE AND TEXTING SERVICE (UNIVERSAL APPLICABILITY) – 911 LIMITATION OF LIABILITY AND INDEMNIFICATION
Relying on the Outbound Service or Texting Service as an exclusive means for access to emergency services is a violation of these T&Cs. You acknowledge and agree that 2nd Line+ will not be liable for any service outage and/or inability to dial 9-1-1 using 2nd Line+ Products and Services or to access emergency service personnel due to the 9-1-1 dialing and messaging characteristics and limitations listed herein. YOU ACKNOWLEDGE AND AGREE THAT NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, 2ND LINE+, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, COMMERCIAL PARTNERS AND UNDERLYING CARRIERS (COLLECTIVELY, THE “2ND LINE+ PARTIES”) WILL NOT BE LIABLE FOR ANY CLAIMS, DEMANDS, ACTIONS, INJURY, DEATH OR DAMAGE TO PERSONS OR PROPERTY, ARISING DIRECTLY OR INDIRECTLY OUT OF, OR RELATING IN ANY WAY TO THE PROVISION OR NON-PROVISION OF 9-1-1 AND/OR EMERGENCY 9-1-1 SERVICES, INCLUDING, WITHOUT LIMITATION, ANY INABILITY ON YOUR PART TO ACCESS 9-1-1 AND/OR EMERGENCY 9-1-1 SERVICES, DEFECTIVE ACCESS TO 9-1-1 SERVICES, INFERIOR ACCESS TO EMERGENCY SERVICES AS COMPARED WITH OTHER TYPES OF CALLING OR TEXT MESSAGING SERVICES OR OTHER PROVIDERS, DELAYED ACCESS TO 9-1-1 SERVICES, IMPAIRED ACCESS TO 9-1-1 SERVICES, OR BLOCKED ACCESS TO 9-1-1 SERVICES, AND YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE 2ND LINE+ PARTIES, FROM ANY LIABILITIES, CLAIMS, DAMAGES, LOSSES ARISING DIRECTLY FROM THE PROVISION, INFERIOR OR DEFECTIVE PROVISION, OR NON-PROVISION OF 9-1-1 AND/OR EMERGENCY 9-1-1 SERVICE ASSOCIATED WITH THE OUTBOUND SERVICE AND THE TEXTING SERVICE.

INBOUND SERVICE LIMITATIONS

When you elect to subscribe to the Inbound Service, you may receive one telephone number attributed to your account by 2nd Line+ for the use of the Products and Services. You agree to comply with all federal and state laws and regulations of the United States, as well as any law or regulation you may be subject to in any other country with respect to the use of the telephone number assigned to you by 2nd Line+.
You acknowledge and agree that the telephone number assigned to your account by 2nd Line+ may be ported outside of the Products and Services only with the explicit consent of 2nd Line+ and may not be ported. Number portability may result in additional fees being charged to your account.
2nd Line+ may reclaim any telephone number it assigns to your account and discontinue its availability to you at any time and without liability whatsoever to 2nd Line+. Furthermore, in the event of termination or discontinuance of the Inbound Service for any reason, 2nd Line+ will reclaim, without notice and at no cost to 2nd Line+, the telephone number associated with the Inbound Service account.

TEXTING SERVICE LIMITATIONS
In certain countries, the Texting Service may enable 2nd Line+ users to send and receive SMS and MMS at no charge to 2nd Line+ users. We do not make any representations as to what occurs or is offered in other countries outside of the U.S.

ADDITIONAL LIMITATIONS ASSOCIATED WITH THE OUTBOUND SERVICE, INBOUND SERVICE, AND TEXTING SERVICE
You acknowledge the right for 2nd Line+ to suspend all or part of the Outbound Service, Inbound Service, or Texting Service at no liability to 2nd Line+ if your usage of 2nd Line+ Products and Services is inconsistent with normal use. Normal use will be determined by 2nd Line+ in a manner relevant to each separate service offering and subject to 2nd Line+’s sole discretion. In some, but not all, cases, this may mean that services are measured compared to other 2nd Line+ users, to industry-wide averages or norms, or to traffic patterns consistent with human as opposed to machine operation. However, 2nd Line+ reserves the right to evaluate what it considers normal use according to any single or number of factors and in its sole discretion according to the disclosed or other factors.
If We determine that your usage violates these T&Cs or other User Agreements with respect to usage limitations, we may: (a) notify you of the excessive use and demand that it cease immediately, and (b) unilaterally suspend temporarily or indefinitely your access to and use of the relevant service or to all Product and Services where 2nd Line+ shall not be liable for any costs, losses, or other liabilities associated with such suspension; or (c) demand payment for such usage.

2.4 User Content: While utilizing the app, users may generate content. You retain ownership of any intellectual property rights in the content you create. However, by uploading content to the app, you grant MobileOcean a non-exclusive, worldwide, royalty-free, sublicenseable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the app.

2.5 Usage Guidelines: Users agree to use the 2nd Line+ app in compliance with all applicable laws and regulations. Furthermore, users agree not to use the app for any unlawful or prohibited purpose or in any manner that could damage, disable, overburden, or impair the app.

3. Privacy and Data Security

3.1 Privacy Policy: Your use of the 2nd Line+ app is also subject to our detailed Privacy Policy. Please take the time to review the Privacy Policy to gain a comprehensive understanding of how we collect, use, and safeguard your information.

3.2 Security: While we implement robust security measures to protect your data, complete security cannot be guaranteed. Users are responsible for ensuring the security of their account information.

4. Intellectual Property

4.1 Ownership: The 2nd Line+ app, including all content, features, and functionality, is exclusively owned by MobileOcean and is protected by copyright, trademark, and other intellectual property laws.

4.2 License: MobileOcean grants users a limited, non-exclusive, non-transferable, and revocable license to use the 2nd Line+ app for personal, non-commercial purposes.

4.3 Third-Party Content: The app may contain links to third-party websites or services that are not owned or controlled by MobileOcean. MobileOcean disclaims any responsibility for the content, privacy policies, or practices of any third-party sites or services.

5. Termination

MobileOcean reserves the right to terminate or suspend user access to the 2nd Line+ app at any time, with or without cause, and with or without notice.

6. Modifications to the Terms

MobileOcean retains the right to update or modify these Terms at any time. The updated Terms will be effective upon posting. Users are encouraged to regularly check for updates. Continued use of the 2nd Line+ app after modifications constitutes acceptance of the updated Terms.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey. Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in Istanbul, Turkey.

9. Entire Agreement

By using the 2nd Line+ app, users acknowledge that they have read, understood, and agree to these comprehensive Terms of Use.
