1. Acceptance of Terms

These Terms of Use and End User License Agreement (collectively, the “Agreement”), together with all documents referred to herein, constitute a legally binding agreement between you, as a natural person (“you,” “your,” or “user”), and MOBILEOCEAN BİLİŞİM YAZILIM ANONİM ŞİRKETİ (“we,” “us,” or “our”), regarding your access to and use of the 2nd Line+ mobile application (the “App”).

The App’s name may vary in countries outside the U.S. and is subject to change without prior notice.

All documents related to the App are expressly incorporated herein by reference.

Please read this Agreement carefully before downloading, installing, or using the App.

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agreed to this Agreement, which becomes effective on the date you first access the App. By using the App, you agree to comply with this Agreement in full.

If you do not agree with any part of this Agreement, you are not authorized to access, download, install, or use the App, and you must immediately discontinue use and remove the App from all devices under your control.

2. Use of the 2nd Line+ App

2.1 Eligibility
To use the 2nd Line+ app, you must be at least 16 years of age. By using the App, you represent and warrant that you meet this age requirement.

2.2 User Account
Certain features of the App require the creation of a user account. You are responsible for maintaining the confidentiality of your account credentials and agree to assume full responsibility for all activities conducted through your account.

2.3 Prohibited Activities
Users are strictly prohibited from engaging in any activities that are illegal, harmful, deceptive, or infringe on the rights of others. Prohibited activities include, but are not limited to, spamming, hacking, harassment, or any form of unauthorized access.

2.3.1 Misuse of Services
You agree not to misuse the Services in any manner, including, but not limited to:

(a) Copying, reverse engineering, disassembling, modifying, or creating derivative works of the App, website, or Services.
(b) Interfering with or disrupting any user, host, or network forming part of the Services.
(c) Accessing the Services by means other than the supported interfaces provided by the Company.
(d) Exploiting the Services in any unauthorized way, such as overloading network capacity or trespassing on restricted systems.
(e) Employing automated programs (e.g., bots, clones) for non-person-to-person communications that impair our ability to deliver Services.
(f) Engaging in atypical calling patterns inconsistent with normal individual use, such as repeated short calls or calls to multiple numbers in rapid succession.
(g) Using the Services for call-in lines, call centers, conference calling, trunking to PBX systems, spamming, bulk messaging, or other high-volume multi-person communications on unlimited subscription plans.

2.3.2 Other Prohibited Activities
You shall not use the Services for purposes prohibited by law or in violation of the rights of others, including:

(a) Pornographic, indecent, obscene, defamatory, or otherwise unlawful purposes.
(b) Collecting, storing, accessing, or using personally identifiable information about other users in violation of the Privacy Policy or these Terms.
(c) Interfering with or restricting anyone’s use or enjoyment of the Services, or causing harm to the Company or its users.
(d) Sending harassing, threatening, or abusive messages.
(e) Discriminating against or harassing others based on race, national origin, religion, gender, sexual orientation, disability, medical condition, marital status, age, or gender identity.

2.3.3 Monitoring and Enforcement
The Company reserves the right to monitor use of the Services for purposes including service security, fraud prevention, risk assessment, investigation, customer support, and compliance with these Terms. The Company may refuse service, terminate accounts, remove or edit content, and revoke licenses for violations of these Terms or engagement in illegal or criminal conduct.

2.3.4 Emergency Calling
The Services are not intended for emergency calling, including 911 or other emergency numbers. Users must always use their primary phone number for emergency calls. By using 2nd Line+, you acknowledge and agree that the Company is not liable for any claims, damages, or losses resulting from attempts to place emergency calls using the App.

2.3.5 Texting and Outbound Service – Limitations for 911
Emergency Access via Text or Outbound Service:
Most users in the United States cannot reach 911 via text message using 2nd Line+. Even in locations where text-to-911 is technically possible, it is strongly recommended to place a voice call to 911 for emergencies. Text messages sent to 911 may not automatically transmit location information, and you may need to provide your location manually. If a text message to 911 cannot be processed, you may receive a notification indicating that the message was not delivered.

Prohibition on Emergency Calls:
You must not use the Outbound Service or Texting Service to place 911 or other emergency calls. Relying on 2nd Line+ as an exclusive means of contacting emergency services is a violation of these Terms.

Limitation of Liability and Indemnification:
By using 2nd Line+, you acknowledge and agree that the Company, its affiliates, officers, employees, agents, and partners (collectively, the “2nd Line+ Parties”) are not liable for any claims, injuries, damages, or losses arising from the inability to access 911 or emergency services using the App. You agree to indemnify and hold harmless the 2nd Line+ Parties from any liabilities, claims, or damages related to the use, non-use, or defective access to 911 and other emergency services.

2.3.6 Inbound Service Limitations

2nd Line+ reserves the right to reclaim any assigned number at any time, without notice or liability, including in the event of subscription termination. If you subscribe to the Inbound Service, you may be assigned a telephone number for your account. You agree to comply with all applicable laws and regulations in your jurisdiction when using the assigned number. Telephone numbers assigned by 2nd Line+ may only be ported with explicit consent from 2nd Line+ and may incur additional fees.

2.3.7 Additional Service Limitations

  • 2nd Line+ is not liable for any costs, losses, or damages resulting from such suspension. 2nd Line+ reserves the right to suspend all or part of the Outbound, Inbound, or Texting Services if usage is inconsistent with normal individual use.
  • “Normal use” may be determined by comparing your usage to other 2nd Line+ users, industry standards, or traffic patterns consistent with human operation.
  • If excessive or abnormal usage is detected, 2nd Line+ may:
    – Notify you and demand immediate cessation of excessive use;
    – Temporarily or permanently suspend access to the relevant service(s); and/or
    – Require payment for excessive usage.

3. Privacy and Data Security

3.1 Consent to Share Consumption Data with Apple
By using the 2nd Line+ App and making in-app purchases, you consent to the sharing of data related to your usage and consumption of purchased content with Apple. This information may include details about how you access and interact with purchased content and is shared solely to assist Apple in processing refund requests. We ensure that any data sharing is conducted in compliance with Apple’s policies and only to the extent necessary to resolve your requests.

3.3 Security
We implement industry-standard security measures to protect your data from unauthorized access or disclosure. However, complete security cannot be guaranteed, and you are responsible for maintaining the confidentiality of your account credentials and other sensitive information associated with your account.

4. Intellectual Property

4.1 Ownership: The 2nd Line+ app, including all content, features, and functionality, is exclusively owned by MobileOcean and is protected by copyright, trademark, and other intellectual property laws.

4.2 License: MobileOcean grants users a limited, non-exclusive, non-transferable, and revocable license to use the 2nd Line+ app for personal, non-commercial purposes.

4.3 Third-Party Content: 2nd Line+ App utilizes third-party services to ensure the proper functionality and uninterrupted operation of the App and its Services. By using the App, you authorize MOBILEOCEAN BİLİŞİM YAZILIM ANONİM ŞİRKETİ to manage your user account—including the phone number assigned to you and related information—solely for technical support and operational purposes.

5. Termination

MobileOcean reserves the right to terminate or suspend user access to the 2nd Line+ app at any time, with or without cause, and with or without notice.

6. Modifications to the Terms

MobileOcean retains the right to update or modify these Terms at any time. The updated Terms will be effective upon posting. Users are encouraged to regularly check for updates. Continued use of the 2nd Line+ app after modifications constitutes acceptance of the updated Terms.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey. Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in Istanbul, Turkey.

These Terms constitute the entire agreement between users and MobileOcean regarding the use of the 2nd Line+ app and supersede any prior agreements.

10. Effective Date

These Terms are effective as of October 28, 2025.

By using the 2nd Line+ app, users acknowledge that they have read, understood, and agree to these comprehensive Terms of Use.
